PA Data Policy

Data offered on data.pa.gov is collected and vetted by publishing entities (i.e.; the entities indicated in the “Agency” portion of a data set’s metadata). The website data.pa.gov is presented by the Commonwealth of PA Governor’s Office of Administration (OA), which facilitates the collection and publication of the data. The terms “data” and “data set” are used in this Policy interchangeably.

Data sets available through data.pa.gov are offered free and without restriction.

Data Quality and Retention, and Liability

Data sets made available on data.pa.gov are provided as a public service on an “as is” basis. All data sets accessed through data.pa.gov have been reviewed for quality by their publishing entity.

Although the publishing entities will continue to strive to ensure that the data sets are accurate, the Commonwealth, OA, the publishing entities and other entities make no warranty, representation or guarantee of any type as to the quality, content, accuracy, timeliness, completeness or fitness for any particular purpose or use of any data sets provided on data.pa.gov; nor shall any such warranty be implied, including, without limitation, the implied warranties of merchantability and fitness for a particular purpose.

The Commonwealth assumes no liability for:

• any errors, omissions or inaccuracies in the data, regardless of how caused;
• any decision made or action taken or not taken by anyone using or relying upon the data;
• any virus or other damage to any computer that might occur during or as a result of accessing data.pa.gov or the data provided therein;
• any other act or omission associated with the access to and use of the data.

The Commonwealth reserves the right to discontinue availability of content on the data.pa.gov at any time and for any reason.

Secondary Use

The Commonwealth cannot vouch for, nor does the Commonwealth necessarily agree with or endorse, any analyses conducted with data retrieved from data.pa.gov.

Attribution

While not required, when using data from data.pa.gov in your own work, we ask that proper credit be given. An example citation is provided below:

Applicability of this Data Policy

Nothing in this Data Policy alters or impedes the the Commonwealth’s ability to perform its responsibilities under law and consistent with applicable legal authority, nor does this Data Policy limit the protection afforded any information by other provisions of law. This Data Policy is intended only to ensure the orderly management of information offered by the Commonwealth on data.pa.gov, and it is not intended to, and does not, create any right or benefit, substantive or procedural, enforceable at law or in equity, by a party against the Commonwealth, its Departments, Agencies or other entities, its officers, employees, or agents.

Changes

The Commonwealth reserves the right to amend this Policy at any time and without further notice. Please revisit this Policy regularly to ensure you are aware of its content.
